Terms: what a bid actually costs

The money layer, from the official terms. Closing costs are paid with the down payment on sale day, so the day one cash number is bigger than the 25 percent alone.

Down payment25 percent of the total contract price (high bid plus buyer premium), paid on the day of the auction on execution of the Offer to Purchase form, with closing costs also paid at that time. Total contract prices of $250 or less are paid in full at the auction.
Payment forms acceptedCash or guaranteed funds payable to Orleans County Treasurer (FDIC insured banks). Credit cards may be used for the minimum deposit only, never the full contract price.
Buyer premium11 percent when the deposit is paid by credit card. 10 percent for cash or guaranteed funds.
Advertising fee1.5 percent of the bid price.
Other fees and closing costsPaid with the down payment: New York State transfer tax ($4 on the first $1,000, $2 per additional $500), Real Property Transfer Report filing fee ($125 for class codes 100 to 199, 200 to 299, and 411-C; $250 otherwise), $5 Combined Gains Affidavit fee, and deed recording ($50 first page plus $5 per page). The buyer also takes on the levied 2026 Town and County bill, 2026 and 2027 school taxes, and the 2027 Town and County bill.
Balance dueOn or before Friday, December 18, 2026, in cash or guaranteed funds to the Orleans County Treasurer Office. Miss it and the deposit is forfeited. No selective closings.
Deed typeQuitclaim deed only, recorded by the County after payment in full. Possession is forbidden until the deed records.

One line from the terms is worth planning around: the buyer counts as the owner for taxation as of the sale, before the deed records.

Before you bid

The terms state the County acquired title under RPTL Article 11 and that all known rights of redemption were extinguished by the foreclosure proceedings. Every bid is still subject to approval by the Orleans County Legislature, which may reject any bid.

Verify before you go: dates and terms were checked on October 15, 2026, and counties can change them. Read the official terms on the auction page before you register.
